Mesothelioma Lawsuit Advance Settlement

Mesothelioma is a rare cancer that currently has no known cure. It is almost always caused by exposure to asbestos. The dangers of asbestos exposure have been known for years, long before the government began to regulate its use. But even after the dangers were known and regulation began, employers still made use of products made with asbestos, exposing their employees to the risk of mesothelioma. Because of this negligence, large numbers of lawsuits have been filed resulting in mesothelioma settlements.

Asbestos has been used for a long time but it hit its peak after World War II and was used in anything from vehicle brakes to ceiling tiles in homes and public buildings to insulation material. It has been used in shipyards for shipbuilding and repair as well as in oil refinery and chemical plants and many more industries. People who worked in these industries where asbestos was used undoubtedly received high levels of asbestos exposure. Because mesothelioma can take 20 to 50 years to show symptoms, there are thousands of cases every year still being diagnosed.

Aviation Accidents Personal Injury Settlement

October 24th, 2010 by Darryl Woodson. No Comments »

The settlements in aviation accidents often depend on the outcome of the accident. Often lawsuits involving aviation accidents are filed either as personal injury claims or wrongful death claims. If the passenger on the airplane that was involved in the accident is alive and is suing for injuries, the case will be tried as a personal injury case. If the passenger died in the accident and the suit is being brought by the deceased’s family, the case is a wrongful death case.

There are many things to consider when litigating an aviation accident case. Negligence on the part of the pilot, the airplane mechanics, air traffic controllers, or the airline itself must be proven in court. The extent of the injuries sustained during an aviation accident can range from mild to severe and can encompass many different types of injuries, including burns, head injuries, cuts and bruises, broken bones, the loss of limbs, and injuries to the spinal cord. If negligence is proven, and it is shown that had it not been for this negligence the plaintiff would not have suffered his or her injury, a settlement may be awarded.

Swimming Pool Statistics:

Water covers two-thirds of the Earth’s surface. So it’s no surprise that swimming is one of America’s favorite pastimes today. According to the National Swimming Pool Institute, there are over one million residential in-ground swimming pools and another three million above-ground pools throughout the country with more pools being built and purchased each year. Unfortunately, serious and fatal swimming pool accidents are a tragic and regular occurrence every year as well. The National Safety Council reports an estimated 1,000 children and adults will drown annually in swimming pools. Another 50,000 people will require hospital emergency room treatment for swimming pool accidents.

Causes of Swimming Pool Drownings:

Drowning occurs when a person is submerged under the water for over 4 minutes depriving the brain of the necessary oxygen to maintain life. The majority of swimming pool drownings involve children under the age of 19. Most often this disaster occurs when children are swimming alone or swimming without adult supervision. Drownings involving children between the ages of 1 and 4 are most often caused when children wander into a yard through an open gate and fall into the pool unnoticed.

Personal injury lawsuits involving amusement parks usually bring to mind serious accidents involving the malfunction of a ride. While these cases grab your attention in the headlines, they don’t represent the majority of amusement park personal injury lawsuits.

Instead, the majority of amusement park lawsuits involve much more routine injuries, usually not involving the park’s major rides. The most common type of lawsuit is the “slip and fall” variety, where patrons have been injured on the sidewalks, in shops, or during shows. Some of the routine accidents could happen anywhere, such as slipping on a wet sidewalk or tripping over a carelessly placed hose. There are also lawsuits involving food safety or contamination at the restaurants and food courts.

Assault victims should know that they have grounds for a civil court case if they have ever been in a situation where they feared for their safety or where they were injured by another individual. The civil case would normally fall under the category of an assault and battery personal injury settlement.

Assault and battery settlements are different from criminal cases in that a district attorney will decide the case that they want to pursue, and the result of a defendant being found guilty or innocent leads to either jail time, a fine, or both. If you are the victim, you might have to testify without any compensation except for a small witness fee. In a civil case, you as the defendant get to decide whether or not to pursue as a plaintiff, where in you will be eligible to seek compensation for any injuries, mental or physical, that you sustained during the assault.

Asbestos Personal Injury Settlement

September 26th, 2010 by Darryl Woodson. No Comments »

In 1920, medical professionals discovered that asbestos caused harmful diseases in the human body. This finding was disturbing because the construction industry considered asbestos an ideal material for construction. Companies continued to utilize this substance; they cited that it was inexpensive and it was highly durable. Unfortunately, millions of workers across the world continued to be exposed to this harmful substance. The fibers in asbestos can be inhaled into the lungs. The substance tends to become airborne, and the worker can then breathe it in. The sharp fibers can become lodged in the lungs. Medical professionals have attributed several severe medical conditions to asbestos. First, asbestosis is a condition that occurs when the lung tissue is scarred. This is believed to be due to the body’s release of acids when asbestos is introduced into the lungs. The acid causes scarring. Also, mesothelioma is a condition caused by the irritation of the mesothelial lining of the lungs. This condition causes cancer in the person. Cancer in other bodily organs can also occur due to asbestos exposure.
