Bus Crash Kills One in Texas

A Valley Transit Greyhound bus was sideswiped by a pickup truck in Highway 77 in Texas. As the pickup truck got into the highway from an intersecting road, it crashed into the bus, causing the driver to lose control of the vehicle and hit a utility pole. A trooper from the Department of Public Safety described the accident and noted that 21 passengers were injured in the crash while one was killed.
Of the total 24 passengers onboard the bus, 21 were taken to the hospital for treatment and 17 were released for minor injuries. Four of the injured were kept for observation and further treatment. The woman who was killed by the crash was sitting near the front of the bus at the time of collusion.
According to witnesses, the bus driver had no time to react as the pickup truck collided onto the passenger side of the bus. The driver of the pickup truck was given a ticket for failure to yield the right of way; additional charges may be filed upon further findings.

Hixton Woman Convicted In Accident That Injured Four Amish Teens

A Hixton woman has pleaded guilty for causing a drunk driving accident that injured four teenage boys who were driving Amish buggies. The Pioneer Press reports that the 49-year-old woman was convicted of one felony charge of hit-and-run involving injury and three charges of causing an injury via intoxicated driving.
Witnesses at the scene of the accident said that they saw the woman leave a tavern before she hit the teens who were driving three buggies with lanterns on the back. They also testified that the woman drove off after the accident which seriously injured one of the teens.
Police managed to quickly track down the woman’s vehicle because her license plate was found among the crash debris. Police officers spoke with the woman within a half-hour of the accident and she initially stated that she had driven into a ditch. The woman then changed her story and said she thought she had hit a woodchuck. Eventually the woman admitted to having been drinking and failed field sobriety tests.
The district attorney said that she wanted the woman to spend a year in jail and that restitution was important in this case. It was also revealed that the woman has three prior drunken driving convictions. And will be sentenced following the completion of the pre-sentencing report.

Electric Company Must Pay 948k For Car Accident

The family of a mentally ill man who was fatally struck by a car as he walked on an unlighted road recovered $948,000 in damages.
In 2005, Paul Wojewski, 57, who suffered from bipolar disorder, was walking in the center lane of Belt Line Road in Dallas when he was hit by a car driven by Alejandro Garcia. Mr Wojewski’s family said Mr Garcia couldn’t see Mr Wojewski before the accident because the streetlights on the road weren’t working. They blamed TXU Electic Delivery Co.for the lack of streetlights alleging that they knew of the faulty lights weeks before the incident but had failed to rectify the situation.
TXU argued, in their defence, that Mr Garcia was at fault and also blamed Mr Wojewski for failing to take his medication.
The family also sued Mr Wojewski’s psychiatrist, Dr. Michael Rosenthal, alleging he allowed Mr Wojewski to leave his office unescorted while in the midst of a manic-depressive episode two days before the accident. The doctor settled this claim prior to trial for an undisclosed amount. The jury found TXU 40 percent, Rosenthal 40 percent and Wojewski 20 percent liable, and awarded the family $2.37 million in damages. After the reduction for comparative fault and the earlier settlement, the family recovered $948,000 from TXU.

Car Accidents Kills Two Teenagers

Two Wisconsin teens have been killed in a highway crash.
The accident occurred on a Wednesday at approximately 3:30 p.m. in the Village of Eastman on Highway 27 and Granzow Lane. Authorities say that the 16-year-old driver crossed the center line of the road and then hit a van driven by a 52-year-old Holmen man.
The collision caused a fire to erupt in the teens’ car which was eventually extinguished by passersby. Emergency crews arrived at the scene and extricated the 16 year-old driver and a 15 year-old passenger from their vehicle with the Jaws of Life. The rescuers also pulled a 10-year-old passenger from the backseat of the car who required surgery on a broken leg. The 16 year-old driver and the 15 year-old passenger were both pronounced dead at area hospitals. The van driver had a serious foot injury and was treated at Prarie du Chien Memorial Hospital.

Automotive Accident in Arlington

The intersection of North Cooper Street and East Lancaster Avenue on Texas 180 was closed for about an hour due to a three-vehicle accident. A 2009 Cadillac Escalade crashed into a 2002 Ford truck. The truck then side swiped a 2010 Toyota. The collision occurred at around 8:45pm.
The driver of both the Escalade and the 2002 Ford were transported to the local hospital. They are both said to be in stable condition. Meanwhile, the driver of the 2010 Toyota was treated at the scene with minor injuries. According to witness report, the 2009 Escalade was at fault for the accident. The car reportedly beat the red light before colliding with the Ford truck.

Oakland Car Crash Injures Two Men

Two men got injured on Monday night when a 2009 Ford F-150 hit a 2002 Isuzu Axiom XS in the rear. The accident occurred in Oakland, CA at the cross section of West Grand Avenue and Telegraph Avenue. Witnesses at the nearby Taco Bell say that the driver of the Axiom yielded to take a left turn on West Grand Avenue when the truck crashed into its rear.
The impact of this crash sent the Axiom into the oncoming traffic. Fortunately, the driver of the Axiom sustained only minor injuries. No other vehicles got involved in the accident. This is the second car accident that occurred at the intersection of Telegraph Avenue in as many days.

Traffic Slowdown Cause Car Accident in Florida

Two vehicles that were traveling southbound on I-75 just north of Sarasota, Florida collided. One vehicle crashed into the back of another due to the sudden slowdown of traffic. A witness said that the car that crashed into the other vehicle was speeding. It was driving in the far left lane before switching to the middle lane.
When vehicles ahead slowed down due to congestion, the 33-year-old speeding driver slammed into the car that was being driven by a 29-year-old. The driver who was hit was treated at the scene of the accident. He was also taken to a nearby hospital for further medical examination. Fortunately, the injuries are not considered life-threatening. The other driver was treated at the scene and cited for reckless driving.

Milwaukee Car Accident Kills One

One person was injured in Milwaukee after a car collided with a motorcycle. The accident occurred late Wednesday morning at the intersection of East Wells Street and North Jackson Street. Reports indicate that the car was being driven by a 21-year-old student who was driving east on route 32. She beat a red light and crashed into a motorcyclist.
Authorities reported that that the motorcyclist was hit on the right before being thrown off the bike. The motorcyclist landed on a side of North Jackson Street and laid there until emergency help arrived. The emergency units said that the victim was in serious condition although they did not specify the extent of the injuries.
While the investigation is ongoing, it has emerged that the car driver was using her mobile phone at the time of the crash. They also ruled out alcohol as a cause of the accident.

$0 Award for Future Pain and Suffering Award Leads to Retrial

In a car accident, when a certain amount has been awarded for past pain and suffering as well as future medical expenses but nothing for future pain and suffering, then under New York law – a new trial should be set.
This is exactly what happened in the case of 17-year-old Lindsay Grobman. She was riding a vehicle driven by Adam Chernoff when it got involved in a head-on collision. She suffered from head, back, and neck pain. The details of her injury were typical of car crash victims. In the four years of the trial, the following details were uncovered:
- Pain at the scene of the accident, taken by ambulance to the nearest hospital
- X-rays shows negative
- One week or so out of work
- Return to work, but feeling pain
- Diagnosis of lumbar or cervical bulging or herniated disks
Lindsay continued to feel pain and EMG shows that she has nerve damage on the next. Four years after the accident, Lindsay still claims that she feels pain on her neck. Her doctors said this was caused by bulging or herniated disks that were identified and that it was permanent. The defense’s doctor says that she has recovered from the car accident.
A trial in 2000 has determined that the driver was 100% at fault for the accident. A second jury was tasked to set the amount for damages. They awarded $10,000 broken down as follows:
- $1,100 for past pain and suffering
- $0 for future pain and suffering
- $8,900 for future medical expenses
The plaintiff appealed and argued that the verdict was inconsistent in finding permanent injury but failing to provide for future pain and suffering. On May 2005, a sum of $125,000 was awarded to the plaintiff. The court confirmed the award and said that the jury’s failure to provide damages for future pain and suffering was inappropriate.
